Hereinafter referred to as the Seller.
1. General, definitions
1.1 These General Terms and Conditions (GTC) apply to the business relationship between the seller and the customer in the version valid at the time of the order.
1.2 consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to his or her commercial or independent professional activity. Entrepreneur are natural or legal persons or partnerships with legal capacity who, when concluding a legal transaction, act in the exercise of their commercial or independent professional activity. Customers within the meaning of these General Terms and Conditions are both consumers and entrepreneurs.
1.3 Individual contractual agreements take precedence over these Terms and Conditions. Deviating or supplementary terms and conditions shall only become part of the contract if their validity has been expressly agreed upon.
2. Conclusion of contract
2.1 The presentation of the goods on the seller's website does not constitute a legally binding offer, but rather an invitation to the customer to submit an offer. Technical or color deviations of the products presented are possible.
2.2 By clicking the button “Order for a fee” the customer places a binding order for the items contained in the shopping cart.
2.3 The seller confirms receipt of the order by email.
a) For advance payment/transfer The contract is concluded upon dispatch of the order confirmation or delivery of the goods. The seller reserves the right to accept the offer within two working days.
b) When paying by credit card or PayPal The contract is concluded with the customer's payment instruction, provided that the order process is fully completed.
2.4 The conclusion of the contract is subject to the availability of the ordered goods. The seller will inform the customer in case of unavailability and refund any payments already made.
2.5 The contract text will be saved by the seller and sent to the customer by email after the contract has been concluded.
3. Retention of title
3.1 The goods remain the property of the seller until full payment has been made.
3.2 In case of default of payment, the Seller is entitled to withdraw from the contract and demand the return of the goods.
3.3 Entrepreneurs may resell the goods in the ordinary course of business. Claims arising from such resale are assigned to the seller in advance.
3.4 The Seller undertakes to release securities at the Customer’s request if their value exceeds the claims by more than 10%.
4. Remuneration
4.1 The stated purchase price is binding and includes statutory VAT. Any applicable shipping costs are listed in the "Shipping" overview.
4.2 Payments are due within seven days of receipt of the invoice. In case of late payment, statutory default interest will apply.
4.3 Set-off or assertion of rights of retention is only permissible in the case of legally established or undisputed counterclaims.
5. Payment options
5.1 Payment is made in advance/by bank transfer, credit card or PayPal.
5.2 If you pay by credit card, your account will be debited immediately after the order has been completed.
5.3 When paying via PayPal, the terms of use of the payment service provider apply.
6. Delivery
6.1 Delivery is made to the countries listed in the “Shipping” overview.
6.2 Delivery times within Germany are specified on the product page. The delivery period begins depending on the selected payment method.
6.3 If the start or end of the period falls on a public holiday, Saturday or Sunday, the period shall be extended accordingly.
7. Transfer of risk
7.1 For consumers, the risk passes to the customer upon delivery of the goods.
7.2 For entrepreneurs, the risk shall pass to the customer upon handover of the goods to the carrier.
8. Warranty
8.1 The statutory warranty regulations apply, as adapted by these General Terms and Conditions.
8.2 Consumers may choose between repair and replacement. For businesses, the warranty is provided at the seller's discretion.
8.3 The warranty period is two years for consumers and one year for businesses.
9. Limitations of Liability
9.1 The Seller shall not be liable for slight negligence in respect of immaterial contractual obligations.
9.2 Liability for damage to life, body or health remains unaffected.
9.3 The seller assumes no liability for the content of external links.
10. Final provisions
10.1 The laws of the Federal Republic of Germany apply. Consumers are protected by mandatory provisions of their country of residence.
10.2 The place of jurisdiction for disputes with merchants is the registered office of the Seller.
10.3 The Seller does not participate in dispute resolution proceedings before a consumer arbitration board.
